1. Acceptance of Terms

These Terms & Conditions ("Terms") are a legally binding agreement between you ("User") and Alestra L.L.C-FZ ("Company", "we", "us", "our"), governing your use of the Plantily mobile application ("App").

By installing or using the App, you confirm you are at least 3 years of age (or have parental consent if under 13) and agree to these Terms in full.

2. License to Use

We grant you a limited, non-exclusive, non-transferable, revocable license to install and use the App on your personal Android device(s) for personal, non-commercial purposes, subject to these Terms.

You may not:

• Copy, modify, or distribute the App or its source code
• Reverse engineer, decompile, or disassemble the App
• Use the App for commercial, unlawful, or unauthorized purposes
• Attempt to gain unauthorized access to the App's infrastructure or AI systems
• Use automated tools to bulk-process plant images through the App

3. AI Identification — Accuracy Disclaimer

Plantily uses artificial intelligence to identify plants and detect diseases. You understand and agree that:

• AI identification results are for informational and educational purposes only and are not guaranteed to be 100% accurate
• Results should not replace professional botanical, agricultural, or medical advice
• We are not liable for any actions taken based on plant identification or disease detection results
• Mushroom identification results are provided as guidance only — never consume a mushroom based solely on the app's identification. Always consult a qualified mycologist before consuming any wild mushroom
• Plant disease treatment suggestions are general guidance and should be verified with a horticulturalist or agricultural expert for critical decisions

4. User-Uploaded Photos

By uploading or capturing photos through the App, you confirm that:

• You have the right to use and submit the photos
• The photos do not violate any third-party copyrights or privacy rights
• You grant us a limited, temporary license to process the photos solely for generating identification results
• You retain full ownership of your original photos

5. Reminders and Notifications

The App offers watering and care reminders. You understand that:

• Reminders depend on your device's notification settings and battery optimization settings
• We are not liable if reminders fail to deliver due to device restrictions, OS limitations, or connectivity issues
• You can manage or disable reminders at any time within the App or through your device's notification settings

6. In-App Purchases

The App may offer optional premium features through in-app purchases. All purchases are processed securely through Google Play.

• All purchases are final unless required otherwise by applicable law
• Refund requests are subject to Google Play's refund policy
• Purchased features are tied to your Google account
• We may modify available premium features at any time

7. Acceptable Use

You agree not to use the App to:

• Submit photos containing illegal, violent, or offensive content
• Attempt to trick or exploit the AI identification system
• Use the App in any way that could damage, disable, or impair it
• Violate any applicable local, national, or international laws

8. Intellectual Property

All content, code, design, logos, trademarks, plant databases, and AI models within the App are the property of Alestra L.L.C-FZ or its licensors. The "Plantily" name, icon, and associated branding may not be used without prior written consent.

9. Privacy

Your use of the App is governed by our Privacy Policy, incorporated into these Terms by reference.

10. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind. We do not warrant that the App will be error-free, uninterrupted, or that AI identification results will be fully accurate for every plant or mushroom species.

11. Limitation of Liability

To the maximum extent permitted by law, Alestra L.L.C-FZ shall not be liable for any indirect, incidental, or consequential damages resulting from your use of the App, including any harm resulting from reliance on plant or mushroom identification results. Our total liability shall not exceed the amount paid for in-app purchases in the three months preceding any claim.

12. Updates and Modifications

We may update the App and these Terms at any time. Continued use after changes constitutes acceptance. We may add, modify, or remove features without prior notice.

13. Termination

These Terms remain effective until terminated. You may terminate by uninstalling the App. We may suspend access for violations of these Terms.

14. Governing Law

These Terms are governed by the laws of the United Arab Emirates. Any disputes shall be subject to the exclusive jurisdiction of UAE courts.
